Terms and Conditions

These Terms and Conditions apply to all photography and videography services provided by Blue Mountains Media (“we”, “our”, or “us”). By booking or using our services, you (“the client”) agree to the following terms.

Blue Mountains Media provides freelance photography and videography services focused on documentary-style storytelling, nature cinematography, environmental imagery, outdoor adventure content, conservation projects, tourism promotion, and promotional media for adventure or outdoor-based businesses and organisations.

A booking is considered confirmed once both parties have agreed to the project details and any required deposit or payment arrangements. Blue Mountains Media reserves the right to refuse or cancel bookings where necessary.

Invoices issued by Blue Mountains Media must be paid within fourteen (14) days of the invoice date unless otherwise agreed in writing. Failure to pay within this payment period may result in delayed delivery of final content, cancellation of future work, additional fees, or recovery action where required.

Final edited photographs, videos, and other deliverables will only be provided once full payment has been received unless otherwise agreed in writing.

Clients are responsible for providing accurate information relating to locations, dates, schedules, permissions, access requirements, and project details. Delays or limitations caused by the client, venue, weather, or third parties may affect the final result or available shooting time.

Blue Mountains Media retains full creative control over all photography, videography, editing, colour grading, audio design, framing, composition, and storytelling decisions. All work is produced in a documentary and cinematic style consistent with our creative approach.

Raw or unedited photographs, video clips, audio recordings, project files, or source files are not included in any service and will not be provided unless explicitly agreed to in writing before the project begins.

Clients may not edit, manipulate, alter, apply filters to, crop, re-grade, use AI modifications on, or otherwise modify any photographs or videos created by Blue Mountains Media without prior written permission. This includes editing by third parties, screenshots, overlays, or social media filters that alter the original presentation of the work.

All photographs, videos, and media created by Blue Mountains Media remain the intellectual property and copyright of Blue Mountains Media unless otherwise agreed in writing. Clients are granted a non-exclusive licence to use delivered content for agreed personal or commercial purposes depending on the project agreement.

Blue Mountains Media may use selected photographs, videos, or project content for portfolio display, website galleries, promotional material, competitions, advertising, social media, or marketing purposes unless privacy is requested in writing before the project date.

While every reasonable effort is made to capture and preserve all content, Blue Mountains Media is not liable for circumstances outside of our control including but not limited to severe weather, track closures, environmental hazards, accidents, wildlife activity, equipment malfunction, transport delays, illness, natural disasters, acts of nature, or restrictions imposed by authorities or property owners.

Blue Mountains Media is not responsible for missed shots, reduced coverage, or project limitations caused by unsafe conditions, inaccessible locations, restricted access, participant behaviour, or events beyond reasonable control.

In the unlikely event that photographs, videos, or files are damaged, lost, corrupted, or unable to be delivered due to technical failure or circumstances beyond reasonable control, liability is limited to the total amount paid by the client for the affected service.

Estimated delivery timeframes are provided as a guide only and may vary depending on workload, project complexity, seasonal demand, weather conditions, or editing requirements.

Clients are responsible for backing up delivered content once received. Blue Mountains Media is not obligated to permanently archive client files after final delivery.

Any abusive, threatening, unsafe, illegal, or inappropriate behaviour towards Blue Mountains Media may result in immediate termination of services without refund.

These Terms and Conditions may be updated at any time without prior notice. Updated versions will be published on the website.
